NYS Comptroller’s Audit Finds Fraudulent Construction Bids Made to SUNY Downstate Medical Center

“An audit that was triggered by three anonymous letters revealed that fake bids were made for construction contracts at the State University of New York Downstate Medical Center, says New York State Comptroller Thomas P. DiNapoli.

According to the audit, Brooklyn-based Eagle Two Construction and its affiliated fake companies were paid $1.2 million by SUNY between January 1996 and October 2010. The affiliated companies, which are all located at the same address, had submitted competing bids in six separate procurements, some of which were forged, according to the findings made by DiNapoli’s auditors and investigators.

“SUNY Downstate Medical Center has worked closely with the office of the state comptroller on its audit of Downstate’s procurement practices and cooperated fully with its review,” said the hospital in a statement. “We will continue to work with [DiNapoli] to ensure compliance with state procurement regulations, monitor purchasing practices, and reinforce internal controls.”

Ex-city contractor sentenced in gun, drug case

“A former city of Dayton asbestos contractor was sentenced Wednesday to two years in prison and three years probation on drug and weapons convictions in Cincinnati.

Penland was president of the now-defunct AR Environmental Inc., which won more than $1 million in demolition and asbestos removal contracts from the city of Dayton in 2009 and 2010, but was later sued for alleged fraud and noncompliance.

In Dayton, Penland’s company was hired despite his five previous felony convictions — four on gun or drug charges — and the company was eventually cited for multiple violations by the Regional Air Pollution Control Agency.

The city of Dayton terminated its contracts with AR Environmental late in 2010, then sued Penland and his company in U.S. District Court in October 2011, saying AR performed “bogus” asbestos surveys, filed fraudulent invoices and demolished vacant buildings without properly removing cancer-causing asbestos.”

Contractors Settle Suit Over Hiring

“Federal prosecutors and the contractors building the East Side Access passage from Long Island to Grand Central Terminal have quietly settled a civil lawsuit that accused the companies of lying about their compliance in hiring disadvantaged businesses as subcontractors on the federally funded project.

The lawsuit, which was brought by the office of the U.S. attorney in Manhattan, Preet Bharara, alleged that the contractors “engaged in lies and subterfuge” to make it appear that they had hired disadvantaged businesses as subcontractors, as required by federal regulations, when they in fact hadn’t.”

Feds file suit against East Grand Forks contractor

“The complaint says R.J. Zavoral and Sons mislead the U.S. Army Corps of Engineers Corps and the U.S. Small Business Administration on a portion of East Grand Forks’ flood-control project. The firm allegedly partnered with a minority-owned firm to acquire the contract, but did most of the work itself, contradicting the conditions of the contract. ”
